A trial has started in Vernon provincial court over a water contamination incident three years ago. The Regional District of North Okanagan is fighting four charges under the BC Water and Drinking Protection acts including allowing contamination of drinking water and failing to provide potable water. The other charges are introducing a foreign matter into a well and operating a well in manner to cause adverse impact. Manure spread onto a field in Lavington by a farmer got into the Antwerp Spring water source on January 13th, 2010, leading to a week long Do Not Drink the water order for 1,800 residents in Lavington and Coldstream. A series of one of a kind weather events at the time, such as heavy rain flowing over a frozen field, contributed to the incident. There were no proven illnesses tied to the incident. Last June, Coldstream farmer Rod Palfrey of Pan-o-Ramic Farms was fined two thousand dollars plus ordered to provide $14,000 to a conservation trust fund, after he plead guilty to introducing waste that caused pollution. The District of Coldstream, which operated the water system, plead guilty to failing to provide potable water, and water fined $16,000. The RDNO owned and managed the water system. The trial is scheduled for five days, three this week, and continuing February 4th and 5th.
