Unusual Impaired Driving Case

Peter McIntyre Friday, 29 October 2010 16:10 107.5 KISSFMA Lumby electric bike driver was not able to be charged with impaired drivingWas it impaired driving---or not?  Lumby RCMP say they came across a complicated case where a drunk man was driving a motorized 'E' bike.
He was driving late at night without a headlight and swerving  over the road.  However, Corporal Henry Proce says an 'E' bike -- which is a bicycle with an electric motor and pedals -- is not considered a motor vehicle, therefore the operator couldn't be charged with impaired.
The vehicle has to be a 50 CC or greater gasoline driven scooter or motorcycle, for that charge to apply.
