Sanitary Sewer Use Bylaw Enforcement Agreement

On Monday March 12 Vernon City Council declassified a motion relating to the Sanitary Sewer Use Bylaw Enforcement Agreement between the City Of Vernon and Okanagan Spring Brewery. Essentially the city extended the deadline from Dec. 21, 2006 until July 1, 2007 to allow the Brewery to provide an implementation strategy and time line to reduce BOD and TSS loading from the plant. The enforcement of the bylaw if the Brewery fails was changed from Jan. 1,2007 to August 1, 2007. (Charges below)

Although this bylaw change was declassified on the same day as it was amended at an in-camera meeting, the recorded vote of the in-camera meeting was not revealed. Rule 89(2) of the Community Charter (see excerpt below) seems to be silent on whether this is necessary but seems to be quite definite on whether an incamera vote of this nature on a bylaw should have been passed.

General rule that meetings must be open to the public
89 (1) A meeting of a council must be open to the public, except as provided in this Division.
(2) A council must not vote on the reading or adoption of a bylaw when its meeting is closed to the public.
