KAMLOOPS, B.C. — Admitted child murderer Allan Schoenborn asked God to bless the justice of the peace who released him from custody just two days before his children were killed, a judge heard Friday. Merritt RCMP Const. Scott Mcdiarmid was the officer who conducted Schoenborn's bail hearing after the man was arrested for threatening a nine-year-old girl at his daughter's school on April 3, 2008. Mcdiarmid opposed Schoenborn being released and asked justice of the peace Fraser Hodge to keep the man in jail until he could appear in court in Kamloops four days later. The officer told the justice Schoenborn had already been arrested two other times the same week. As well, the man tried to flee police after he was arrested by bolting for a side door at the detachment. It was locked.Mcdiarmid said he was concerned Schoenborn was "willing and capable of threatening a nine-year-old girl." He also noted the man had a lengthy criminal record, including breaches of court orders.
Hodge, however, released Schoenborn, saying while he had "grave concerns" about doing so, he was prepared to give the man a break. A tape of the 20-minute telephone bail hearing was played in court. "I know we are close to the line on this one," Hodge told Mcdiarmid near the end of the hearing, "but I am going to give Mr. Schoenborn a chance."
Said Hodge to Schoenborn: "I have grave concerns about both your criminal record and your behaviour, in particular (because) it relates to a young child. "I want you to remember you got a good break on this and, you know, appreciate that. Don't let anything go wrong," the justice said. "God bless you," Schoenborn said to Hodge when he learned he would be released.
Two days later, his three children were killed in the family's trailer in Merritt, B.C. In detailed testimony earlier in the trial, Schoenborn related how he stabbed Kaitlynne, 10, and smothered Max, 8, and Cordon, 5. He's testified he killed the children to protect them from being sexually molested. There is no evidence any of the children had ever been abused by anyone.
