Decision on Harvey's sentence to be announced in the Future.

The court today heard the pleadings of both the Crown and the defense re the charge laid against former Vernon Mayor Sean Harvey. The court accepted Mr. Harvey's guilty plea. The court decided in view of the legal submissions re case law etc. that a decision would be best made at a future court date.

The underlying amount of the expense account misappropriations was set at $13,838.60 of which $5250.00 has been paid by Mr. Harvey to the City of Vernon. There was no dispute about the facts of the case and the lawyers spent most of their time talking about case law dealing with the imposition of a conditional sentence.

The only charge being argued was Breach Of Public Trust as the theft over $5000 appears to have been stayed.

The Crown suggested a proper sentence was a conditional sentence of 18 months while the defense suggested a more suitable sentence was in the 8 to 12 month range.

The Judge set a date of this 23rd for the two lawyers to meet with the court scheduling clerk to suggest a sentencing date.
